Article 2: Applicability
These Terms and Conditions apply to all offers, orders, and agreements made through the KAIKO&CO website (kaikoandco.com). By placing an order, you confirm that you have read and accepted these Terms and Conditions.
KAIKO&CO reserves the right to amend these Terms and Conditions at any time. The version in effect at the time your order is placed applies to your purchase.
These Terms and Conditions are available on the KAIKO&CO website and can be downloaded and saved as a PDF. A link to these Terms and Conditions is included in all order confirmation emails.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by a provision that most closely reflects the original intent.
Article 3: The Offer and Agreement
All offers on the KAIKO&CO website are non-binding. KAIKO&CO reserves the right to modify or withdraw any offer at any time.
An agreement is formed the moment you complete your order and receive an order confirmation by email. KAIKO&CO will send this confirmation to the email address you provided. Please check your spam folder if no confirmation arrives within 24 hours.
KAIKO&CO reserves the right to refuse an order in cases of suspected fraud, incorrect pricing due to a manifest technical error, or an item that is no longer available.
As all items in the KAIKO&CO shop are unique, one-of-a-kind vintage or antique objects, each item exists in a quantity of one. In the rare event that an item has already been sold through another channel at the time your order is placed, KAIKO&CO will inform you immediately and issue a full refund within 14 days using the same payment method.
Article 4: Prices and Payment
All prices shown on the website are in Euros (EUR) and are inclusive of Dutch VAT, calculated under the margin scheme (margeregeling). Under the margin scheme, VAT is applied to the profit margin only rather than the full sales price, as required by Dutch and EU law for second-hand goods. As a result, no separate VAT amount is shown on your invoice.
Shipping costs are shown separately at checkout before you complete your order. The total price you confirm at checkout, including shipping, is the total amount you pay.
Accepted payment methods are shown at checkout. Payment is processed securely via Squarespace Payments. KAIKO&CO does not store your payment details.
All orders must be paid in full before dispatch. If payment is not received within 3 business days of the order being placed, KAIKO&CO reserves the right to cancel the order and make the item available for purchase by others.
In the case of an obvious pricing error on the website, KAIKO&CO is not bound by that price. KAIKO&CO will contact you as soon as possible and offer you the option to purchase at the correct price or to cancel your order with a full refund.
Article 5: Delivery and Shipping
KAIKO&CO ships to all European Union member states. We do not ship outside the EU at this time. Customers based outside the EU are welcome to contact us at hello@kaikoandco.com to discuss options.
Shipping costs depend on your destination and are calculated and displayed at checkout before you complete your order. The rate shown at checkout at the time of your order applies.
Orders are dispatched within 2 to 3 business days of payment confirmation, via PostNL. You will receive a tracking number by email once your order has been dispatched. Estimated delivery times per destination are shown at checkout and are provided by the carrier; they are estimates only and not guarantees. In any event, KAIKO&CO aims to ensure delivery within 30 days of the order confirmation. If this cannot be met, KAIKO&CO will notify you and you will have the right to cancel the order for a full refund.
KAIKO&CO is not responsible for delays caused by the carrier, customs authorities, or circumstances beyond our control.
Packaging
All KAIKO&CO orders are packed with care, using recycled and reused materials wherever possible. All ceramic, lacquerware, and other fragile items receive additional padding.
Damaged or Lost Parcels
If your order arrives damaged or is confirmed lost by the carrier, please contact us at hello@kaikoandco.com as soon as possible, and ideally within 48 hours of delivery or of the expected delivery date. Please include:
Your order number
Clear photographs of the damaged item
Photographs of the original outer packaging, including the box or envelope
Please retain all original packaging until the matter is fully resolved. KAIKO&CO will work to find a fair resolution and, where applicable, file an insurance claim with the carrier. Our ability to do so depends on your cooperation in providing the above within the stated timeframe.
Article 6: Right of Withdrawal
As a consumer purchasing from KAIKO&CO, you have the legal right to withdraw from your order within 14 calendar days of receiving your item, without giving any reason. This right is provided under Dutch and EU consumer protection law (Directive 2011/83/EU, implemented in the Dutch Civil Code).
How to exercise your right of withdrawal
To withdraw from your purchase, you must notify KAIKO&CO in writing within 14 calendar days of the day you received the item. You can do this:
By email to hello@kaikoandco.com, clearly stating your order number and your intention to withdraw
By using the model withdrawal form included at the end of these Terms and Conditions (Annex A)
KAIKO&CO will confirm receipt of your withdrawal notification by email.
Returning the item
After notifying KAIKO&CO of your withdrawal, you have 14 calendar days to return the item. The item must be sent within this period; the postmark or carrier receipt date applies.
The item must be returned in its original condition, unworn and unused beyond what is necessary to assess its nature and condition, and with any original packaging, documentation, tomobako, or box that was included with the purchase. Items that have been used, damaged, or returned incomplete may be subject to a reduction in the refund amount proportional to the diminished value.
Please pack all returns carefully. KAIKO&CO strongly recommends using a tracked and insured shipping method. We cannot accept responsibility for items lost or damaged in transit on return.
Return shipping costs
Return shipping costs are at the buyer's expense. KAIKO&CO does not provide prepaid return labels. You are responsible for arranging and paying for the return shipment. Please obtain a shipping quote from your carrier before initiating a return; this is typically in the range of EUR 10 to EUR 25 for standard parcel delivery within the EU, depending on destination and package size.
Refund
Once KAIKO&CO has received and inspected the returned item, we will process your refund within 14 calendar days, using the same payment method as your original purchase.
We will refund the purchase price of the item. We will also refund outbound shipping costs equivalent to our standard shipping rate for your destination, provided you return your entire order. If the returned item shows signs of use, damage, or is returned without included original materials, KAIKO&CO reserves the right to deduct an amount proportional to the reduction in value.
KAIKO&CO may delay the refund until the returned item has been received, or until you have provided proof of shipment, whichever is earlier.
Article 7: The Nature of Vintage and Antique Goods
All items sold by KAIKO&CO are authentic vintage or antique objects, personally sourced in Japan. Items may date from the late Meiji period (ca. 1900) onwards. Objects that can reasonably be established as more than 100 years old are described as antique. As such, the following applies:
Each item is unique. Once sold, it cannot be replaced or reordered.
Vintage and antique objects may show signs of age and use, including minor glaze variations, small chips, crazing, fading, oxidation, or patina. These characteristics are inherent to aged objects and are not considered defects.
Any significant damage, visible repairs, restoration, or notable wear is always described and photographed in the product listing.
Dimensions and weights are approximate. Minor variations may occur.
Attribution, Provenance, and Age Assessment
Where a maker, kiln, school, region, period, or approximate age is stated in a product listing, this represents our best professional assessment at the time of listing, based on:
Direct physical examination of the object
Maker's marks, signatures, seals, and inscriptions, including tomobako (original wooden storage box) inscriptions
Style analysis and comparison with documented reference examples
Information provided by sellers, dealers, and specialists in Japan at the time of purchase
Publicly available reference materials, Japanese ceramic and craft registers, auction records, and specialist databases
Consultation with specialists in Japanese antiques and craft where relevant
Attributions in product listings are our informed assessments and are not binding statements or guarantees. Vintage and antique Japanese objects, particularly those acquired through the open market in Japan, rarely come with formal written provenance documentation, official appraisals, or museum-grade authentication. Attributions may be revised if new information becomes available.
Where an attribution is based on stylistic characteristics rather than confirmed documentation, this is stated explicitly in the listing using language such as "in the style of", "consistent with", "attributed to", or "bearing characteristics of".
KAIKO&CO cannot guarantee the attribution, age, or provenance of any item and accepts no liability if an attribution is later found to be incorrect, unless such error constitutes a material misrepresentation that would not reasonably have been detected through professional assessment. This limitation does not affect your statutory rights as a consumer under Dutch and EU law.
By purchasing from KAIKO&CO, you acknowledge that you are purchasing a vintage or antique object on the basis of a professional assessment, and that such assessments carry inherent uncertainty.
Acceptance of Age and Condition
Vintage and antique objects are not new goods. By placing an order, the buyer confirms that they understand and accept the following:
The item is a used object that has been owned and, in many cases, used before. It carries its history.
Signs of age and use are normal and expected: light scratches, minor glaze variations, small areas of wear, craquelure, patina on metal, silk and wood, slight fading, or minor surface marks are inherent characteristics of aged objects. Their presence does not constitute a defect and does not give rise to a right of return on these grounds alone.
Each item is described and photographed as accurately as possible. Any significant damage, repair, or notable wear beyond light age-related marks is always disclosed in the product listing and/or shown in photographs. If you are uncertain about the condition of an item before purchase, please contact KAIKO&CO at hello@kaikoandco.com before ordering.
Handmade ceramic objects may show minor irregularities in form, glaze application, or surface texture. These are characteristics of the making process, not defects. This also applies to lacquer ware.
If an item arrives in a condition that is materially inconsistent with its description, please contact us. KAIKO&CO will always work to find a fair solution.
Article 8: Customs, Import Duties, and Regulatory Compliance
The buyer is solely responsible for determining whether the import of the purchased item is lawful in their country of destination, and for paying any applicable customs duties, import taxes, VAT on importation, carrier handling fees, or any other charges levied by the authorities of the destination country. These costs are not included in the purchase price or shipping costs charged by KAIKO&CO.
Under current EU rules, goods shipped between EU member states are generally not subject to customs duties. However, KAIKO&CO makes no binding representation that this will remain the case, and accepts no liability if applicable rules change after the time of purchase. It is the buyer's responsibility to verify the current import rules for their country before placing an order.
KAIKO&CO is not responsible for delays caused by customs inspection or processing. KAIKO&CO will not falsify shipping documentation, understate the value of items, or describe items as gifts in order to circumvent import duties or regulations.
Article 9: Export Compliance and Cultural Property
KAIKO&CO sources all items through legal channels in Japan, including licensed antique dealers, registered auction houses, and open antique markets. KAIKO&CO does not knowingly purchase, hold, or sell items that are subject to export restrictions under Japanese law, including objects designated as Important Cultural Properties (重要文化財) or National Treasures (国宝) under Japan's Law for the Protection of Cultural Properties.
Items are imported into the Netherlands in compliance with applicable Dutch and EU import regulations. By purchasing from KAIKO&CO, you confirm that importing the item into your country of residence is lawful.
Article 10: Statutory Warranty and Conformity
Under Dutch law, goods must conform to the purchase agreement. For vintage and antique objects, conformity is assessed against the standard that a reasonable buyer would expect of an aged object of the described type, period, and condition, taking into account the disclosures made in the product listing.
Age-related wear, patina, minor crazing, and small variations in glaze or form are inherent characteristics of vintage and antique objects and do not constitute non-conformity. If an item is significantly different from what is described in the listing, or if a defect exists that was not disclosed and could not reasonably have been detected from the photographs and description, please contact KAIKO&CO within 14 days of receiving the item. We will assess the situation and work towards a fair solution.
Your statutory rights as a consumer under Dutch and EU law are not affected by anything in these Terms and Conditions.
Article 11: Force Majeure
KAIKO&CO is not liable for any failure or delay in fulfilling its obligations under these Terms and Conditions caused by circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, war, civil unrest, government actions or regulations, strikes, pandemic-related disruptions, significant carrier delays, or failures of third-party service providers.
In the event of force majeure lasting more than 30 days, either party may cancel the agreement. In such a case, KAIKO&CO will refund any amounts already paid, without additional compensation.
Article 12: Complaints and Disputes
If you are not satisfied with your purchase or our service, please contact KAIKO&CO first at hello@kaikoandco.com. We aim to respond to all complaints within 5 business days of receipt and to resolve them within 14 days. If we require more time to investigate, we will let you know.
If we are unable to resolve your complaint together, you may submit it to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
These Terms and Conditions are governed by Dutch law. Any disputes that cannot be resolved amicably will be submitted to the competent court in the Netherlands.
Article 13: Liability
KAIKO&CO's liability for any claim arising from a purchase is limited to the purchase price of the item in question. This limitation does not apply in cases of intent or gross negligence on the part of KAIKO&CO, nor does it affect your statutory consumer rights.
KAIKO&CO is not liable for: damage resulting from incorrect or inappropriate use of a purchased item; minor colour variations due to screen calibration differences between devices; delays or loss caused by the carrier after dispatch; or damage caused by inadequate packaging by the buyer when returning an item.
Article 14: Privacy
KAIKO&CO processes personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch privacy law. Your data is used solely to process and deliver your order and to respond to your enquiries. Your data is never sold to third parties.

Article 15: Intellectual Property
All content on the KAIKO&CO website, including photographs, written descriptions, and blog posts, is the intellectual property of KAIKO&CO unless otherwise stated. Nothing on this website may be reproduced, copied, or distributed without prior written permission from KAIKO&CO.
